CDM 2015 Regulations

It is our duty of care to point out that from June 2015 all building work undertaken in the UK, no matter what size of project, has a mandatory requirement to meet a Health & Safety specification known as the CDM 2015 Regulation, and to have a health and safety document file for inspection for the design, known as the “Principal Designer” and a file for what is known as the “Principal Contractor” to be in place, for any project undertaken by a client using any services of paid contractors, other than a DIY project where this is not required, which means that you would have to provide Health and Safety documentation should the HSE ask to see the evidence for your project.

Evolved Design can provide this information as the Principal Designer and can act as a Principal Contractor for the purposes of the installation of the work. This mandatory requirement for building cannot be ignored as the HSE have the power to fine clients, and or their Contractors should they have not discharged this requirement to the Principal Contractor in writing, if the HSE find that there has not been any provision in the Design or by the Contractors for a health and safety requirement.

These fines can be very hefty, with fines being over £124 per hour for each individual incident in failure to provide details, which could result in fine in excess of £1,000 per infringement, plus if anything should happen on site which results in the HSE being involved, fines in excess of £20,000 for each incident can be enforced, therefore you are best knowing what is required of you as a client and what you need to have in place from your Principal Contractor before work starts. It is also always best to ensure that the Principal Contractor has full insurance to cover the work they are undertaking for you.

CDM Principal Designer Support – Small Projects

We provide full support to ensure you meet the requirements under the legislation which are to-

  • Assist the client in identifying, obtaining and collating the pre-construction information.
  • Provide pre-construction information to designers, the principal contractor and contractors.
  • Ensure that designers comply with their duties and co-operate with each other.
  • Liaise with the principal contractor for the duration of the appointment.
  • Prepare the health and safety file.

Specifically, our services include-

  • Production and implementation of the Pre Construction information, Designer Risk Register, Health and Safety File and any other designer documentation that maybe required under the CDM Regulations.
  • Telephone and email support regarding any issues.
  • Support and assistance in relation to Local Authority, Health and Safety Executive or Regulatory Fire Inspection and/or Investigation.
  • One visit at your office or at a convenient place to discuss issues.

We provide full support to ensure you meet the requirements under the legislation which are-CDM Principal Contractor Support – Small Projects 

  • Preparing a construction phase plan that ensures the work is carried out without risk to health or safety.
  • Implementing the plan, including facilitating co-operation and co-ordination between contractors.
  • Reviewing, revising and refining the plan and checking work is being carried out safely and without risks to health.
  • Taking steps to prevent unauthorised access to the site by using fencing and other controls.
  • Making sure that suitable facilities are provided throughout the construction phase.
  • Giving workers, visitors and others information about risks and rules that are relevant to the site work and their work.
  • Discussing with the principal designer any design or change to a design.

Specifically, our services include-

  • Production and implementation of the Construction Phase Plan, any other Principal Contractor documentation that maybe required under the CDM Regulations.
  • Production and implementation of site induction, daily register, risk assessments etc.
  • Telephone and email support regarding any Health and Safety issues.
